Terms and Conditions

FixDate is a high-quality erotic portal for sex ads in the EU and Switzerland.
General terms and conditions are regulations that cover the rights and obligations of the users of the erotic platform and the operator.


Services

The online portal FixDate is an erotic portal. FixDate offers sex advertisements as well as contact for private meetings. FixDate enables customers to reading the advertisements and also making contact.
The use of the platform is provided by the operator partly for a fee and partly free of charge. The current price lists apply.
Users are responsible for the use of the platform, the contracts concluded with the service providers and any contact addresses exchanged.
The operator is entitled to send users messages via various communication channels. Users have the right to object to this.
The operator has no obligation to monitor advertisements and user behavior, therefore no liability is assumed for advertisements.
The users and the advertisers are solely responsible for the fulfillment of the contract.
All contracts are concluded without the operator's intervention.
The basis for all advertisements and content on the erotic platform should be the Code of Conduct Hosting (CCH).

Use

The erotic portal FixDate may only be used by persons with full legal capacity. The minimum age to use the erotic portal FixDate is 18 years. Registration as a user is mandatory. The operator may refuse use without giving reasons.
All information must be true. The operator is allows you to check this at any time.
The contract between the customer and the service provider is concluded without any form by using the services in accordance with . Art. 4 para. 2 OR (Code of Obligations).
The contract is concluded after transfer and receipt of the amount to be paid to the service provider.
The service is delivered partly free of charge and partly after payment has been made using the available payment options Twint, VISA, credit card Post Finance , instant transfer.
The basis for all advertisements and content on the erotic platform should be the Code of Conduct Hosting (CCH).

The service is partly provided free of charge and partly after payment has been made using the available payment options Twint, VISA, Post Finance credit card, Sofort Überweisung.
The erotic portal FixDate can only be used for personal use. The user undertakes to use the portal in accordance with the law. The access data and the confidential treatment of exclusive use are also obliged. Access to the portal must not be granted to a third party
The operator assumes no liability for the technical availability of the erotic portal
The right of use will be immediately denied by the operator if the obligations/terms and conditions are not observed.
Any contractual costs remain unaffected.
Fees paid remain unaffected and will not be refunded.
For booked paid services, the operator may require an advance payment request.

Advertisements

Posting advertisements means that users have given their consent to the publication of contact addresses. The operator receives an unrestricted right of use for content protected by trademarks and copyright.
The operator is permitted to enrich metadata and make adjustments. The operator may refuse to publish advertisements without giving reasons. There is no liability for incorrect or unpublished advertisements.
The user undertakes to post legally compliant content. Advertisers must ensure that advertisements are up-to-date, correct and complete.
Advertisements may not contain advertising for sites or offers that promote value-added services such as (0190, 0900 or similar) or use these as a means of access (dialer). Are prohibited.

  • Advertisements for the sale of illegal medical goods (sexual enhancers) 
  • Advertisements for prohibited practices (animals/children) will be reported without warning!
  • Advertisements for so-called online casinos (gambling with money)
  • Advertisements for the purpose of data collection will result in the account being blocked without warning. The contact details will be entered into a blacklist and passed on to our partners.
  • Advertisements for the purpose of online bullying. We save the IPs and timestamps.
  • Advertisements from people under the age of 18 will be reported without warning!
  • FAKE advertisements will be deleted without exception. Even if they have already been paid for. We consider the payment of FAKE advertisements as compensation for our investigative efforts to identify such advertisements
  • All advertisements that violate applicable law

In particular:

  • Incitement to violence (Art. 259 StGB)
  • Offering so-called hard pornography/excrement pornography - pornographic services within the meaning of Art. 197 No. 3 and 3 bis StGB
  • Racial discrimination (Art. 261bis StGB)
  • Depictions of violence (Art. 135 StGB)
  • Illegal gambling within the meaning of the Casinos Act or the Lottery Act

       

Due to the restrictions imposed on the operator by the Data Protection Act (DSG) and the Federal Constitution (BV), the operator cannot accept any liability for this. assume that abusive providers advertise prohibited content in the publications.
The member undertakes to ensure that the advertisements he or she enters do not advertise the above-mentioned content.
The operator is entitled to file a criminal complaint or to press criminal charges.

Liability

The operator's liability is limited to damage caused by its own negligent or intentional actions.
Any further liability is completely excluded.
If someone increases their credit on the service provider's websites through fraud, exploits technical vulnerabilities to their financial advantage or bypasses the payment provider, the offender will be held accountable immediately and a contractual penalty of CHF 1,000 per case will be imposed.

Place of jurisdiction and applicable law

Disputes arising from this legal relationship shall be subject exclusively to the ordinary courts at the company headquarters, subject to different mandatory places of jurisdiction under federal law.

Final provisions

Access to the erotic platform with boots, scripts or similar is prohibited.
The operator may cease operation of the erotic portal permanently or temporarily without notice and without giving reasons. If provisions of these terms and conditions are unfulfillable or invalid, this does not affect the validity of the other provisions.
The operator is entitled to exercise the rights and obligations of the terms and conditions through third parties or to transfer them.
In such a case, the erotic portal and the user undertake to replace the ineffective provision with an effective one that corresponds to the original intention of the parties. The severability clause does not apply to consumers.
